These Terms & Conditions (“Terms”) govern your use of Glowtox NYC’s website, services, treatments, and all transactions (“Services”) provided by Glowtox, located in New York, NY (“Glowtox,” “we,” “us,” “our”). By using our website, booking or receiving services from us, purchasing products, or otherwise interacting with Glowtox, you agree to these Terms. If you do not agree with any part of these Terms, you must not use the site or our services.

1. Services, Treatments & Products

1.1 Consultations & Medical Disclaimer

• All services that involve medical, dermatological, or aesthetic procedures are provided by licensed medical professionals.
  
• Any information provided on the website or during consultations is for general informational purposes and does not constitute medical advice. You agree to follow advice of your provider and disclose all relevant medical history.
  
  

1.2 Booking, Deposits, Cancellation & Changes

• Appointments must be booked as per our policies. Certain services may require deposits or prepayment.
  
• Canceling or rescheduling must be done within 48 hours, or cancellation fee of $150 will apply.
  
• Glowtox reserves the right to refuse or reschedule appointments for any reason (provider illness, emergencies, etc.).
  
  

1.3 Pricing & Payments

• All quoted prices are in USD and subject to change.
  
• Taxes, fees, and charges may apply.
  
• Payment in full (or otherwise agreed payment plan) is required as per policy.
  
  

1.4 Products

• If you purchase skin care or other products, all product sales are subject to product-specific return/refund policies.
  
• Products must be unused, in original packaging, unless otherwise allowed under policy.

2. Your Responsibilities

2.1 Accuracy of Information

• You agree to provide accurate, current, and complete information about yourself and any medical history or conditions that may affect your suitability for treatments.
  
• You must inform us of any allergies, previous treatments, medications, changes in health status, pregnancy, etc.
  
  

2.2 Follow-Up & Aftercare

• Aftercare instructions given must be followed. Glowtox is not responsible for failures to follow aftercare which affect results or well-being.
  
• If you notice unexpected reactions, you must contact us promptly.
  
  

2.3 Conduct

• You will act respectfully toward staff, providers, and other clients/customers. Disruptive, abusive, or unsafe behavior can lead to refusal of services or termination.
  
  

3. Limitations, Disclaimers & Liability

3.1 No Guarantees

• While we aim for high-quality results, individual outcomes can vary. We do not guarantee specific results.
  
• Factors affecting results (skin type, genetics, health, age, etc.) are largely outside our control.
  
  

3.2 Limitation of Liability

• To the extent permitted by applicable law, Glowtox’s liability arising out of or in connection with your use of services, treatments, products, or website is limited to the amount you paid for the service or product in question.
  
• Glowtox is not liable for indirect, incidental, special, punitive, or consequential damages, including lost profits, loss of enjoyment, loss of business, or emotional distress, even if Glowtox was advised of the possibility of such damages.
  
  

3.3 Indemnification

• You agree to indemnify, defend, and hold harmless Glowtox, its owners, affiliates, employees, agents, and service providers from any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your negligence or willful misconduct, or your violation of any laws or rights of third parties.
  
  

4. Intellectual Property & Use of Website

4.1 Ownership

• All content on Glowtox’s website: images, text, logos, graphics, designs, trademarks, and service marks, is owned or licensed by Glowtox and protected by applicable copyright, trademark, and other intellectual property laws.
  
  

4.2 Limited License

• You may view, download, or print materials from this site solely for personal, non-commercial use. Any other use (reproduction, distribution, commercial exploitation) is prohibited without express written permission from Glowtox.
  
  

5. Privacy

• Our Privacy Policy describes how we collect, use, disclose, and protect your personal data. By agreeing to these Terms, you also agree to the terms of our Privacy Policy.
  
  

6. Payments, Financing & Refunds

6.1 Payment Methods

• We accept payment via cash, accepted credit/debit cards, and Patient Fi financing.
  
  

6.2 Financing

• If you choose financing (e.g., payment plans), you are subject to terms of the financing provider. Glowtox is not the financing provider. You must meet their requirements, and any non-payment or late fees are your responsibility.
  
  

6.3 Refunds

• Glowtox does not offer refunds for any services performed. All service sales are final.
• For product purchases, Glowtox will not accept any opened products for return or exchange. Unopened products may be returned or exchanged within 14 days (2 weeks) of purchase for a full refund or exchange.
  

7. Dispute Resolution; Arbitration & No Court Lawsuits

7.1 Governing Law

• These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles.
  
  

7.2 Agreement to Arbitrate / Mediation

• You and Glowtox agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of services or products, or any other interaction with us shall be resolved first through good-faith mediation, administered by a mutually agreed mediator in New York, NY.
  
• If the dispute is not resolved via mediation within ___ days after the notice of dispute is submitted, then the dispute shall be resolved exclusively by binding arbitration under the rules of the American Arbitration Association (or another agreed arbitration body).
  
  

7.3 Waiver of Jury Trial & Class Actions

• You and Glowtox both waive to the fullest extent permitted by law the right to a trial by jury.
  
• You also waive any right to participate in a class, consolidated, or representative action.
  
  

8. Termination

• Glowtox may suspend, terminate or restrict your access to our website or Services at any time, without notice, if you violate these Terms, or for other reasons in Glowtox’s discretion.
  
• Even after termination, certain sections of these Terms (e.g. Indemnification; Limitation of Liability; Dispute Resolution) shall survive.
  
  

9. Modifications & Changes to Terms

• Glowtox reserves the right to change or update these Terms at any time. Changes become effective upon posting on the website, unless otherwise stated.
  
  
• It is your responsibility to review these Terms periodically. Continued use of services or site after the changes implies your acceptance.
  
  

10. Miscellaneous

10.1 Severability

• If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court or arbitrator, that provision will be enforced to the fullest extent permitted; the remaining provisions will remain in full force.

• These Terms, along with any policies, forms, prints you sign, and the Privacy Policy, constitute the entire agreement between you and Glowtox concerning the subject matter herein, superseding any prior agreements or understandings.
  
  

10.3 Waiver

• No waiver by Glowtox of any right under these Terms shall be deemed a waiver of any other right, and failure to enforce any provision is not a waiver of future enforcement.
  
  

10.4 Notices

• Notices under these Terms must be in writing (including electronic) and sent to Glowtox at its principal address (or email) or to you at the contact information you provided. A notice is effective when delivered.
